California Employment Lawyers Association Publishes Article By Andrew H. Friedman

Los Angeles, CA – The February 2018 issue of the California Employment Lawyers Association’s Bulletin (Vol. 32, No. 2) feature an article by Andrew H. Friedman of Helmer Friedman LLP entitled “Practice Guide: 2018 Employment Law Update: An Overview Of New Legislation And Case Law Trends.” An excerpt of the article follows:

For plaintiff employment law attorneys, the most notable developments of 2017 (and early 2018) are the staggering steps that the administration in Washington has taken to eviscerate the rights of employees. Indeed, immediately upon taking office, the administration launched a wide-ranging crusade to curtail employee protections in virtually every area impacting the employment relationship from wage and hour laws to anti-discrimination laws to occupational health and safety laws and regulations, to the unionized workplace.

Luckily, for those plaintiff employment lawyers living in California, Governor Edmund G. Brown, Jr., the California State Legislature, and the appellate courts, whether federal or state, have continued to protect and expand employee rights. This is particularly true not just with regard to recent employment-related legislation but also with respect to cases addressing summary judgment where the Ninth Circuit and the California Courts of Appeal have continued a recent trend of reversing grants of summary judgment favoring employers and, in doing so, explaining why most employment cases should be decided by a jury.

This article will briefly summarize new employment-related legislation and then examine what appears to be a growing recognition by the courts that summary judgment is usually inappropriate in employment cases…

Attorneys General From Every State, U.S. Territory Pen Letter To Congress Calling For An End To Forced Arbitration For Sexual Harassment

The attorney general of every state, U.S. territory and the District of Columbia have submitted letter to Congress seeking to increase protections for victims of sexual harassment in the workplace. The attorneys general urge Congress to enact federal legislation that guarantees victims of workplace sexual harassment access to the courts instead of being bound by arbitration clauses in employment agreements. The bipartisan effort was led by Florida’s Pam Bondi and North Carolina’s Josh Stein. A copy of the letter can be viewed here.

“Decades of private arbitration proceedings regarding sexual harassment have had the unintended consequence of protecting serial violators, and it must end,” Bondi said in a press release about the letter. Commenting about the letter, Andrew H. Friedman of Helmer Friedman LLP said, “The letter from the attorneys general of every state, U.S. Territory and the District of Columbia is a good start but it doesn’t go nearly far enough. We must abolish forced arbitration not just for sexual harassment but for every type of employment and consumer cases. One of the most effective ways we can root out illegal employment discrimination, harassment, and retaliation and end predatory practices against consumers is by ending forced arbitration agreements. Access to our judicial system is a fundamental right and we should not allow corporations to force employees and consumers to give up their Constitutional right to a jury.”

Andrew H. Friedman Speaks at the American Bar Association’s 11th Annual Labor and Employment Law Conference

Washington, D.C. – On Saturday, November 11, 2017, Andrew H. Friedman spoke at the American Bar Association’s 11th Annual Labor and Employment Law Conference in Washington, D.C. Mr. Friedman, joined by Daniel Engelstein (of Levy Ratner, P.C., New York, NY), Stephanie Padilla (of Johns Manville, Denver, CO), and
Dayna E. Underhill (of Holland & Knight LLP, Portland, OR) spoke on “Ethics Issues in Handling the Dissolution of Firms.” Their panel discussion explored the many questions that arise upon the breakup of a firm. They examined the Model Rules and discussed best practices against the turbulent backdrop that can occur with firm dissolution answering questions such as:

  • Who keeps the clients?
  • What are the rights of the clients to information?
  • How will work best be transferred from one firm to another?
  • What information should a lawyer who has played a principal role in representation provide open departing; and when should it be provided?
  • What conflicts of interest are present?

This panel discussion reprised a similar discussion that Mr. Friedman and Ms. Underhill presented in March 2017 in Puerto Vallarta, Mexico for the Midwinter Meeting of American Bar Association’s Section of Labor and Employment Law and Ethics & Professional Responsibility Committee.
